This presentation examines the compatibility of the Turkish penal system's legal infrastructure with international human rights instruments, especially the European Convention on Human Rights (ECHR) and the United Nations Standard Minimum Rules for the Treatment of Prisoners (Nelson Mandela Rules). Penal systems not only aim to punish offenders but also to protect human rights and reintegrate prisoners into society. The presentation analyzes the impact of international treaties to which Türkiye is a party, particularly on penal practices and their reflection in Turkish legislation. The Law No. 5275 on the Execution of Sentences and Security Measures and related regulations are discussed, focusing on both their legal content and practical effects. The presentation compares how prisoners' rights are regulated in legislation versus their implementation in prisons. Finally, it emphasizes the importance of a rights-based approach and aims to provide an overall framework for assessing the current state of the Turkish penal system from a legislative perspective.
