This presentation discusses the challenges of trying to implement Human Rights in the Indian custodial setting. While in India the law and  procedures do exist to ensure that human dignity is maintained even while incarcerated. Yet, there are various gaps in implementation of procedures. The prison occupancy has been around 130%, since the last few years, the major problem of prison overcrowding, severely impacts various human rights, particularly dignity, privacy and health rights.
 
The workshop will reflect upon some of the landmark judgements given by the Apex Court related to prisoner’s rights and the implementation challenges, and some good practices. The presentation will focus on vulnerable categories of prisoners-women, unsentenced prisoners and the issue of access to justice. The implications of organisational changes and prison staff training are highlighted to show the process of change that has evolved over the last few decades.
