Article 1: A Principled Approach Towards a More Humane Corrections (ACJ17-A001)

Abstract

Building on the work and observations of the International Committee of the Red Cross (ICRC) in places of detention around the world, this paper argues for the application of a principled approach to the design and implementation of any reform, project or initiative within an individual prison or across a penal system despite the context, challenges or resources. Legislators, policymakers, administrators and civil society can move the bar positively along a continuum towards a more humane prison environment by applying the following five principles: 1. The inclusion of the voice of people with lived experience in detention; 2. Do no harm; 3. Maintain a maximum of normality; 4. Promote health and personal growth and 5. Maintain strong connections to society.

Terry Hackett

Head of Unit, Persons Deprived of Liberty, International Committee of the Red Cross, Switzerland

Terry Hackett assumed the post of Head of the Persons Deprived of Liberty Unit for the International Committee of the Red Cross (ICRC) in Geneva in February 2022. Terry joined the ICRC in 2018 as a Prison System Adviser following a 22-year career with the Correctional Service of Canada (CSC) where he began his career as a Correctional Officer and retired as the as the Assistant Deputy Commissioner of Correctional Operations (Pacific).

During his tenure with CSC, Terry held various positions including Director of Operations (Pacific) and Director of several federal institutions. Terry has been called on to present on penitentiary issues in seminars and conferences around the world. He has worked with various detaining authorities in East Africa, Afghanistan and throughout South East Asia to support efforts to ensure the treatment of detainees and conditions of detention are improved in line with international standards.

Terry holds a Master of Arts in Human Security and Peacebuilding from Royal Roads University (RRU) with a focus on rule of law and post-conflict correctional reform, Master of Advanced Studies in International Law in Armed Conflict from the Geneva Academy of International Humanitarian Law and Human Rights as well as a Bachelor of Arts in Psychology from Trinity Western University. Terry has published work in both the South African Journal of Criminology (2015) and the ICPA Journal Advancing Corrections (2017). Prior to joining the ICRC he was the lead consultant for the development of the United Nations Office on Drugs and Crime (UNODC) Nelson Mandala Rules eLearning course.

Anne-Julie Deniel

Head of Protection Framework and Methodology, Persons Deprived of Liberty Division, International Committee of the Red Cross, Switzerland

Anne Julie Deniel is the Head of Protection Framework and Methodology, Persons Deprived of Liberty Division for the International Committee of the Red Cross (ICRC) in Geneva. She joined the organisation in 2013 and has held various positions in detention (Haiti, Salvador & Honduras, Iraq, Afghanistan, Philippines, DRC). In her position as a Regional Detention Analyst for the Eurasia Region, she drafted the publication on Restrictive Detention Regimes. Prior to joining the ICRC, she has worked extensively on prison systems for international (ILANUD, UNODC) and non-governmental organisations (International Prison Observatory, PRI etc). She holds a MA in Criminology and Criminal Justice from King’s College University, London, a MA in International Law from Paris I PanthéonSorbonne University, Paris and a Postgraduate in Human Rights and International Humanitarian Law from Evry Val d’Essonne University, Paris.
